Alternatives to Litigation

The partners of Holland Roddenbery are trained mediators, arbitrators and late case evaluators and have assisted hundreds of parties with all types of alternative dispute resolution. They are frequently chosen to mediate and arbitrate complex cases by respected family law attorneys.

Mediation

shutterstock_272278958Mediation is ideal for cases in which the parties prefer to work toward an agreement rather than fight it out in court. In some cases, issues can be resolved without the involvement of a judge. Instead, an impartial third party such as a family law attorney without a financial incentive in the case or an expert mediator can be used to help the parties reach a settlement.

The attorneys at Holland Roddenbery are strong supporters of using Alternative Dispute Resolution as a way to settle cases and are experts in protecting their clients during the mediation process.

Arbitration and Late Case Valuation

Arbitration is similar to mediation because it includes an impartial third party, but in arbitration, the arbitrator will have legally binding authority to make decisions regarding the case.

Late Case Evaluation again involves a neutral third party but specifically requires that the third party be an expert in domestic relations law. The Late Case Evaluator hears arguments and makes non-binding recommendations regarding settlement. The Evaluator’s extensive experience can assist you in predicting the outcome of your trial and help guide you in settlement negotiations.
